1.  THE INFORMATION WE COLLECT

Information You Provide To Us: We, or our service providers (acting on our behalf), may collect “Personal Information” (which is information that, on its own or when combined with other information, can be used to identify you) that you provide to us either in the capacity of a business owner or employee (“Business Customer”) or as an individual customer of PXG (“Individual Customer”). For example, the Personal Information we collect in the course of providing services to you depends on how you engage with our services:

Ordering through PXG.com (“Website Order”):

• identifiers like contact details (first and last name; email address; telephone number(s); and postal address);
• commercial information, like measurements taken by you (if ordering direct through our e-commerce site); and
• any Personal Information you include in correspondence with us.

Ordering through PXG Fitters (“Fitter Order”):

• identifiers like contact details (first and last name; email address; telephone number(s); and postal address);
• correspondence directly with PXG Fitter(s);
• commercial information, like club fitting measurements taken by PXG Fitter(s) to provide you with services; and
• any Personal Information you include in correspondence with us.

Ordering on-site at a Golf Club or Retailer (“Club Order”):

• identifiers like contact details (first and last name; email address; telephone number(s); and postal address);
• commercial information, like:
• club fitting measurements taken by a Golf Club employee or contractor;
• membership details of the Golf Club; and
• any Personal Information you include in correspondence with us.

Applying for credit from PXG as a Business Customer (“Credit Application”):

When you make a Credit Application, we may receive and use international business data (“IBD”) about your company. In some cases, IBD may include commercial information that is Personal Information about you, such as:

• financial information about you, including information about your mortgage(s), credit card(s), overdraft(s), loan(s) or other;
• your previous business address(es);
• your credit history; and
• any other results of the credit report that has been compiled about your company by the credit reference agency.

Applying for a job (“Job Application”):

• identifiers like contact details (first and last name; email address; telephone number(s); and postal address);
• demographic information such as your age; and
• professional or employment related information.

Entering into an employment relationship (“Employees”):

• identifiers like contact details (first and last name; email address; telephone number(s); and postal address);
• demographic information such as your age;
• professional or employment related information; and
• government issued identification (Social Security Number, driver’s license number, or state issued identification number).

Information Collected Automatically: Whenever you visit or interact with the Site, we, as well as our third-party service providers, may use a variety of technologies that automatically or passively collect information about how you access and use the Site. This may include internet or other electronic network activity information such as:

• Your IP address or other unique identifier for the computer, mobile phone, tablet, or other device you use to access the Site;
• Your device type;
• Your location;
• The type of browser software and operating system you are using; and
• The web page(s) you have accessed, and the time you accessed them.

Collecting this information enables us to better understand the visitors who come to our Site, where they come from, and what content on our Site is of interest to them. We use this information for our internal analytics purposes, to improve the quality and relevance of our Site to our visitors, and for advertising purposes.

Cookies: In our Site and emails, we and third parties may collect certain information by automated means such as cookies, web beacons, JavaScript, mobile-device functionality and other computer code. This information may include unique browser identifiers, IP address, browser and operating system information, other device information, Internet connection information, as well as details about your interactions with our Site and emails (for example, the URL of the third-party website from which you came, the pages on our Site that you visit, and the links you click on in our websites).

Cookies and local storage are files that contain data, such as unique identifiers, that we or a third party may transfer to or read from your devices for the purposes described in this Privacy Notice, such as to recognize the devices, to improve your use of our website and services, for cybersecurity, to prevent fraud, to provide services, and for record-keeping, analytics, and marketing, depending on the context of collection.

These technologies help us:

• Keep track of whether you are signed in or have previously signed in so that we can display all the features that are available to you;
• Remember your settings on the pages you visit so that we can display your preferred content the next time you visit;
• Display personalized content;
• Perform analytics, measure traffic and usage trends, and better understand the demographics of our users;
• Diagnose and fix technology problems; and
• Plan for and enhance our business.

Also, in some cases, we assist with the collection of information by advertising services provided by third parties. The ad services may track your online activities over time by collecting information through automated means such as cookies, and they may use this information to show you ads that are tailored to your individual interests or characteristics and/or based on your prior visits to certain sites or apps, or other information we or they know, infer, or have collected from the users like you.

• Report on our ad impressions, other uses of ad services, and interactions with these ad impressions and ad services (including how they are related to visits to specific sites or apps).

Information from Third Parties: From time to time, we may receive Personal Information about you from third party sources.

For example, we partner with shipping companies such as FedEx. These are third-party service providers we use to deliver products to you, and as such we may collect information from them about your order so that we can ensure our products are delivered effectively, accurately and safely. We also receive personal information from our corporate affiliates including, among others, PXG UK Ltd., PXG Fitters, Golf Clubs (collectively, our “Affiliates”) and from our customers (such as when a customer provides us with the contact details of its employee responsible for purchasing, or when a customer makes a referral).

2.  HOW WE USE YOUR PERSONAL INFORMATION

We use the Personal Information we collect about and from you:

• To build and deliver your PXG products and provide you with other services;
• To enable us to run the Site. For example, we may use your Personal Information: to identify you when you visit our Site or our stores; to complete and fulfil any purchases or requests for products or services; to process returns; to respond to your questions and requests; to communicate with you about changes to any PXG policy or notice; and to improve our services and products and the Site and keep it secure;
• To carry out promotional activities, including email marketing, social media campaigns, and prize promotions through us or our business partners;
• To help develop our business;
• If you have made a Credit Application, to run a credit check on your company for the purposes of determining whether to extend credit to your company;
• To personalize your PXG experience, including: to tailor content, advertisements, and offers we serve you; and for market research and statistical analysis;
• To comply with our legal obligations, to enforce our terms and conditions, and to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others;
• To help us to administer the Site and debug, identify and repair errors that impair existing intended functionality of our Site and services;
• For internal administrative purposes, analytics, research, and reports regarding use of our services;
• To detect and protect against malicious, deceptive, fraudulent, or illegal activity, including violation of our policies and terms and conditions, security incidents, and harm to the rights, property, or safety of our company and our users, employees, or others;
• To verify your identity and for fraud detection and prevention; and
• For such other purposes as you may consent (from time to time).

Although the sections above describe our primary purpose in collecting your information, in many situations we have more than one purpose. For example, if you complete an online purchase, we may collect your information to perform our contract with you, but we also collect your information as we have a legitimate interest in maintaining your information after your transaction is complete so that we can quickly and easily respond to any questions about your order. As a result, our collection and processing of your information is based in different contexts upon your consent, our need to perform a contract, our obligations under law, and/or our legitimate interest in conducting our business. If you do not provide us with the necessary information, depending on the processing activity and the legal basis used for that processing activity, we may not be able to fully and adequately provide services to you.

We may aggregate and/or de-identify information collected through the Sites. We may use or disclose aggregated or de-identified data for any purpose. To the extent we maintain and use Personal Information in a deidentified form, we will not attempt to reidentify the information, except for the purpose of determining whether our deidentification processes satisfy our legal obligations.

5.  THIRD-PARTY LINKS

The Site may contain links to other sites and applications that we are not responsible for such as Facebook, Instagram, and Twitter. We do not control, recommend or endorse these other sites. These other sites may also collect Personal Information about you, and they may have their own privacy policies. We recommend that you review the privacy policy of any site that you access through our Site.

6.  CHILDREN

The Site is not designed for or directed at children. As such, we do not knowingly process Personal Information from or about children under 16 years of age.

7.  CROSS-BORDER TRANSFERS

We are a global company with headquarters in the United States, and the Affiliates and third parties with whom we share the personal data as described in this Privacy Notice are located in the United States and elsewhere in the world, including countries where privacy laws may not provide as much protection as your country. PXG complies with legal requirements for protecting the movement of data across borders, including where appropriate through the use of European Commission and United Kingdom approved Standard Contractual Clauses. 8.  HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?

We retain your Personal Information for as long as necessary to fulfill the purposes set forth in this Privacy Notice or as long as we are legally required or permitted to do so, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless a longer retention period is required or permitted by law. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we obtained the information and whether we can achieve those purposes through other means, as well as applicable legal requirements. Where we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

9.  YOUR RIGHTS AND CHOICES

In some jurisdictions you may have a right to:

• Obtain a copy of your Personal Information held in our possession (or explanation of the categories of Personal Information that we collect and disclose), and in some cases to receive it in a structured commonly used and machine readable format, or have it transmitted to a third party in such form;
• Update, correct or delete your Personal Information;
• Opt out of Promotional Emails/Direct Marketing. You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions in emails that you receive. If you decide not to receive promotional emails, we may still send you service related communications;
• Opt out of Promotional Text Messages. If you receive a text message from us that contains promotional information you can opt-out of receiving future text messages by replying “STOP;”
• Opt-out of Targeted Advertising. You may opt-out of online tracking based targeted advertising (e.g., cookies) by clicking the cookie settings link here or the “Do Not Share” link on our homepage. Please note that if you change browsers or devices, or if you clear your browser’s cache, you may need to click the link again to apply your preference. You may also opt-out of other forms of targeted advertising by submitting a request as described below. We also recognize Global Privacy Control (GPC) signals enabled by customers on their web browser or web browser extension as valid opt-out requests where required by applicable law. • Obtain confirmation of whether we hold your Personal Information and how we are processing it;
• Object to the processing of your Personal Information; and
• Withdraw consent previously provided for the processing of the Personal Information. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

If you make any of the above requests, we may require that you provide us with information to confirm your identity before addressing your request. At a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, that may include verifying your name, email address, and other details. 

You are also permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests, or provide them with a power of attorney. We may also follow up with you to verify your identity before processing the authorized agent’s request.

If you disagree with how we handled a request, you may appeal our decision by contacting us with the subject line “Appeal.” If you are not satisfied with our response, and are in the European Union or United Kingdom, you may have a right to lodge a complaint with your local supervisory authority. Note that we do not discriminate against individuals that exercise statutorily conferred data privacy rights.

10.  SAFEGUARDING YOUR PERSONAL INFORMATION

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your Personal Information from unauthorized access, use, or disclosure, we cannot guarantee the security of your Personal Information. In the event that we are required by law to inform you of a breach to your Personal Information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Some of our websites permit you to create an account. When you do you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. You should notify us of any unauthorized use of your password or account.
